By accessing our website, using our services, booking appointments (in person or telehealth), or creating an account through our practice platform (e.g., Jane App), you agree to these Terms & Conditions.

1) Who May Use Our Website & Services

  • Eligibility. You must be at least the age 19 years and older to access our services.

  • Accurate information. You promise to provide true, current, and complete information when booking, registering, or communicating with us.

  • Lawful use. You agree to use our website and services only for lawful purposes and in a manner that respects other users and our team.

2) Accounts, Security & Our Right to Suspend

  • Account creation. Some features (e.g., scheduling, telehealth, secure messaging) may require an account through our practice platform. Keep your login credentials confidential.

  • Security. If you suspect unauthorized access to your account, notify us immediately.

  • Suspension or termination. We may suspend or cancel accounts or access to services at any time, without liability, if we believe:

    • our Terms, policies, or law have been violated;

    • there is a risk to safety, privacy, or system integrity;

    • you have outstanding unpaid balances; or

    • service is being used inappropriately or abusively.

3) Appointments, Payments & Cancellations

  • Booking. Appointments can be scheduled online (e.g., Jane App) or by phone/email.

  • Payment methods. We accept [list: credit/debit cards, e‑transfer, direct billing if applicable]. Full payment is typically due at or before the session.

  • Insurance. If you use benefits or third‑party payers, you are responsible for verifying coverage and paying any balances not covered.

  • Cancellation & late arrivals.

    • Please cancel or reschedule at least [e.g., 24–48 hours] before your session to avoid a fee.

    • Missed or late‑cancelled sessions may be charged up to the full session fee.

    • Late arrivals may shorten session time but be billed in full.

  • Refunds. Session fees are for professional time and are generally non‑refundable once the session occurs. Prepaid amounts for future sessions may be refunded or credited at our discretion, less any third‑party processing fees.

4) Telehealth & Technology

  • Platform. We may use secure video platforms (e.g., Jane’s integrated telehealth).

  • Your environment. You are responsible for privacy on your end (quiet, private space; secure internet).

  • No recording. Sessions are not recorded unless we mutually agree in writing.

  • Technical issues. If connectivity problems interrupt a session, we will attempt to reconnect or reschedule. We are not liable for outages or failures beyond our control.

5) Not for Emergencies or Crisis

Our services are non‑emergency and not a substitute for emergency psychiatric or medical care.
If you or someone else is at risk of harm, call 911 (or your local emergency number) or contact local emergency/crisis services immediately.

6) Professional Services & Limitations

  • Scope. We provide counselling/psychotherapy within our training and competence. We do not provide medical diagnosis, legal advice, or services outside our scope.

  • Client responsibilities. Counselling outcomes depend on many factors. You agree to participate actively and share relevant information to support your care.

7) Privacy & Confidentiality

  • Privacy policy. Your personal information and personal health information are handled according to our Privacy Policy (available on our website or by request).

  • Legal limits. Confidentiality has legal exceptions (e.g., risk of serious harm, child protection, court orders). We explain these during intake.

8) Intellectual Property (Website Content)

  • Ownership. Website content, logos, graphics, text, and materials we provide are owned by us or licensed to us and protected by copyright and other IP laws.

  • Limited use. You may view, download, or print content for personal, non‑commercial use only. You may not copy, distribute, modify, or create derivative works without our written permission.

9) Acceptable Use of the Website

You agree not to:

  • upload or transmit viruses, malware, or harmful code;

  • attempt to gain unauthorized access to our systems or other users’ accounts;

  • use the website in a way that disrupts, damages, or impairs functionality;

  • post or share unlawful, harassing, defamatory, or infringing content.

10) Changes to Services & Website

We may modify, suspend, or discontinue any part of our website or services (including features, pricing, or availability) at any time, with or without notice. We may also update these Terms to reflect operational, legal, or regulatory changes.

11) Third‑Party Services

Our website and practice platform may link to or integrate third‑party services (e.g., video, payments, forms). We are not responsible for the content, policies, or practices of third‑party sites. Your use of those services is subject to their terms.

12) Warranties & Disclaimers

  • No guarantees. We make no warranties (express or implied) regarding website availability, uninterrupted access, or particular therapeutic outcomes.

  • “As‑is” website. The website is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

13) Liability Limitations

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages (including loss of data, profits, or business opportunities) arising from your use of the website, account, or services.
Our total liability for any claim related to the website or non‑clinical services will not exceed the amount you paid for the specific service giving rise to the claim.

Clinical services: We will provide care consistent with professional standards. Nothing in these Terms limits your rights under applicable health or consumer protection laws.

14) Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the website, or violation of law or third‑party rights.

15) Communications & Consent (CASL)

By providing your email or phone number, you consent to receive administrative communications (e.g., appointment reminders, invoices).
Marketing messages are sent only with appropriate consent and always include an unsubscribe option. You may opt out at any time.

16) Governing Law & Dispute Resolution

These Terms are governed by the laws of the Northwest Territories and applicable federal laws of Canada.
Disputes will first be addressed informally. If unresolved, the parties agree to seek resolution through negotiation or mediation in the Northwest Territories before pursuing litigation, unless urgent court relief is required.

17) Severability & Entire Agreement

If any part of these Terms is found unenforceable, the remaining sections remain in effect. These Terms, together with our Privacy Policy and any written service agreement or informed consent, constitute the entire agreement between you and us regarding website use and non‑clinical aspects of service.

18) Updates to These Terms

We may update these Terms periodically. Changes take effect upon posting to our website with the Effective date above. Your continued use after changes means you accept the updated Terms.
